NOTICE OF SPECIAL TOWN BOARD MEETING TO HOLD A CLOSED SESSION FOR THE PURPOSES OF DISCUSSING LITIGATION

PLEASE TAKE NOTICE that the Town Board of Supervisors of the Town of Barry will hold a special closed meeting at 6:00 p.m. on Tuesday, October 20^th, 2026 at the Barry Town Hall, 35965 Wildlife Road, Hinckley, MN 55037

The purpose of the special closed meeting is for the Town Board to discuss, receive advice, and give information and directions to the attorney who the Town’s insurer, the Minnesota Association of Townships Insurance Trust, has assigned to represent and defend the Town against a lawsuit by William Dorgan regarding a Petition for a Writ of Mandamus. A Petition and exhibits to the petition have been served on the Town Board through its attorney, and the case is filed in Pine County under Case No. 58-CV-26-494. The lawsuit is entitled “William D. Dorgan vs Barry Township and the Barry Township Board of Supervisors.”

This special meeting will begin as an open meeting but will then be closed pursuant to Minnesota Statute 13D.05 subd. 3(b), which is a portion of the Open Meeting Law that allows town boards to close meetings when permitted by the attorney-client privilege. This special meeting will conclude prior to the Town Board’s regular meeting on October 20^th, 2026 at 7:00 p.m.

The reconvening of the annual meeting will be on Sept 15th at 6:30pm before the regular monthly meeting.

The Barry Township Planning Committee will hold a Public Hearing on Thursday, August 13, 2026, at 6:00 p.m. at the Barry Town Hall, located at 35965 Wildlife Road Hinckley, MN to take public comments on Barry Township’s New Zoning Ordinance.

All persons desiring to be heard with reference to the above matter may do so at the public hearing. If you are unable to attend the meeting but wish to comment, you may submit a letter to the Barry Township Planning Committee at the above address, or you may send an email to barrytwpclerk@gmail.com no later than 5:00 p.m. on Wednesday August 12, 2026. Any such communications will be forwarded to the Planning Committee.

The Barry Township Planning Committee will hold a Public Hearing to review and take comments on a request by New Look Construction, for an amendment to their Conditional Use Permit, to allow them to operate a temporary mobile asphalt plant at their gravel pit located at 26140 State Hwy 48, Hinckley MN. The Public hearing will be held on Thursday, August 6, 2026, at 7:00 p.m. at the Barry Town Hall, located at 35965 Wildlife Road Hinckley, MN.
